Verycook SAS is the publisher of the kokko.net service and will hereinafter be referred to as "Verycook" for the purposes hereof.

Verycook attaches great importance to protecting your privacy and your Personal Data, and has always undertaken to use the Personal Data of its customers and prospects only to the extent necessary for the proper operation of the www.kokko.net website and the provision of its offers and services. Personal Data refers to information concerning natural persons, identified or identifiable, directly or indirectly (hereinafter referred to as "Personal Data").

The collection and processing that we carry out are carried out in compliance with the legal framework in force applicable to the protection of Personal Data and in particular, the European Regulation 2016/679 of April 27, 2016, (hereinafter the "Regulation").

The purpose of this Privacy Policy is to explain in greater detail our approach to your Personal Data, the circumstances in which we collect it, the reasons for collecting it and what we do with it (hereinafter the "Policy").

This Policy is intended to apply to Verycook customers, prospects and visitors when browsing the www.kokko.net website (hereinafter the "Site"). The Policy forms an integral part of the Site's General Terms and Conditions of Sale.

1. Who processes your personal data?

Verycook is responsible for collecting and processing your Personal Data. We implement processing dedicated to services and relationship management with our customers and prospects to enable each of them to maintain and repair their vehicle.

Verycook implements measures to guarantee the confidentiality, security and integrity of the customer's personal data, and undertakes to ensure that service providers to whom it subcontracts certain services guarantee the same level of security as Verycook.

2. When do we collect your personal data?

During the course of our relationship, you may be asked to provide us with your personal data when :

- you create an account on the Site;

- you purchase our products or services;

- when you contact our after-sales service, make a complaint or, more generally, when you enter into contact with our customer relations teams and, more generally, during any other direct contact with our teams;

- when you subscribe to the newsletter, participate in marketing studies or a competition, or when you offer to leave reviews on the Site and share them with the customer community;

- When you browse the Site, we use cookies, small text files that are stored on your device (computer, tablet or mobile).

3. What personal data do we collect?

When you use our Site and our services, we collect and process your Personal Data. The Personal Data collected by Verycook concerns the following data:

Personal and contact data: surname, first name, telephone numbers, postal addresses, e-mail address.

Connection data: IP address.

Data relating to transactions carried out on the Site: customer number, invoice numbers, parcel numbers, order history, sales numbers and order numbers.

Data relating to your communications with our customer service department: voice, if you have not objected to its recording.

4. For what purposes do we process your personal information?


For certain processing operations, we ask for your specific consent. You can withdraw your consent at any time.

Verycook processes your Personal Data only for one of the following legally authorized purposes:

- the performance of a contract, for example, to process and fulfill an order;

- fulfilling a legal obligation, such as keeping invoices;

- when it is in the legitimate interest of Verycook ;

- when you have given your consent to the processing of your Personal Data. Examples of legitimate interests covered by the Regulation include fraud prevention, direct marketing and the sharing of Data within a group of companies.

To ensure the security of its payments, Verycook uses systems that enable automated decision-making. These anti-fraud processes, based on a number of parameters (purchase volume, basket size, frequency, etc.), are used to establish an order score. The result of this scoring and its elements are transmitted to Verycook's payment service providers and to the banks issuing your means of payment for secure access to your accounts. This processing and the procedures governing its communication are implemented to meet the requirements of the European Payment Services Directive.

5. How long do you keep your Personal Data?

For processing purposes relating in particular to the creation of your customer account, and the history of your transactions carried out on the Site, your Personal Data is kept for as long as you are an "active" customer and for a period of (5) five years from your last activity, for example, purchase, connection to your account or expiry of a warranty.

For invoicing, accounting and tax purposes, your personal data is kept for a period of (10) ten years in compliance with our legal obligations.

Your communications are kept for as long as is necessary for the purpose for which they are intended, up to a maximum of 6 months. These recordings are kept securely and only authorized persons, within the limits of their respective responsibilities, have access to them.

6. To whom do we pass on your personal data?

We do not share your Personal Data with third parties outside the internal departments and entities of the Verycook group owned directly or indirectly by Verycook, duly authorized to process your Personal Data for the specific purposes referred to in section 3. However, we may transmit your Personal Data to duly authorized external service providers with whom we work, namely certain specialized service providers for the following specific purposes:

- banking transactions (e.g. banks, payment service providers);

- customer relationship management (e.g. call centres);

- after-sales service (e.g. expertise centres);

- product delivery (e.g. carriers);

- informational (e.g. sending the order validation email);

- customer experience (e.g. sending out satisfaction surveys to measure customer satisfaction with our brand, opinions on our products or services).

For the latter, Verycook and its subcontractors have the possibility of contacting the User by email to invite him/her, without compensation, to leave an online review concerning the report/quality of the Product purchased on the Site or to share their Verycook customer experience.

Verycook expressly invites the User to read the General Terms of Use (GTU), which form an integral part of its personal data protection policy.

When we use international service providers located outside the European Union, all necessary measures and formalities are taken to ensure and protect the confidentiality of your Personal Data and to secure the transfer of the Data.

 

7. What are your rights and how can you exercise them?

You have a right to information, as well as a right of access, rectification, limitation, opposition, deletion and portability of your Personal Data, which you may exercise for legitimate reasons, and subject to any compelling legitimate reasons Verycook may have to retain your Personal Data.

You have the right to request :

Access to and correction of your Personal Data. Please note that you can consult and modify your personal information at any time from the "my account" section.

Limitation of the processing of your Personal Data. It is important to note that this right only applies if you have a legitimate reason to do so. By way of example: contesting the accuracy of your Data, defending or exercising your legal rights.

The deletion of your Personal Data. Please note that once your customer account has been deleted, you will no longer be able to :

- consult your order history ;

- consult or download your invoices; consult your reimbursements ;

- use your coupons or vouchers ;

- return new, deposit or warranty parts, and benefit from the preferential-rate return label.

- exercise your right to object to the processing of your personal data for commercial prospecting purposes.

If you are concerned by prospecting :

- by email, you can unsubscribe from newsletters by clicking on the unsubscribe link in each commercial communication;

- If you do not wish your telephone number to be used, you can register free of charge at www.bloctel.fr.

Please note that the withdrawal of your consent, which is possible at any time, will not affect the lawfulness of any processing carried out prior to the withdrawal of consent.

You also have the right to formulate specific and general post-mortem directives concerning the retention, deletion and communication of your Data.

To exercise your rights, which you may exercise at any time, your request should be sent to us as follows:

Requests sent to Verycook must contain your personal information identical to that entered when creating your customer account (last name, first name, email). A copy of proof of identity will be required for processing, in the case of a request sent by post and/or by an email address different from the customer account.

We will send you a reply within one (1) month of receipt of your request. In certain cases, due to the complexity of the request or the number of requests, this deadline may be extended by 2 months.

We have appointed a Data Protection Officer (hereinafter the "DPO") with the CNIL, to demonstrate our commitment to respecting your privacy and your rights with regard to your Personal Data.

If you feel that the processing of your data has not complied with the regulations in force, you may at any time lodge a complaint with the competent supervisory authority (in France, the CNIL).

 

8. Definition and role of cookies

What is a cookie?

A cookie is a file downloaded to a computer, tablet or other mobile terminal when accessing a website. This file can be read by its issuer for the duration of its validity. They enable certain functionalities to function (authentication, use of services such as chat, etc.), as well as recognizing the terminal concerned each time it accesses digital content containing cookies from the same issuer. 9. Suspicious e-mail? What is phishing?

Phishing is a fraudulent technique used by hackers to obtain sensitive, personal and/or confidential information (bank details, identity theft, etc.) belonging to Internet users. To do this, they reproduce a legitimate brand's website design or communications (email) identically.

The most widespread form is the sending of a seemingly official email, the content of which invites the victim to click on a link redirecting them to a seemingly official website where they can communicate their confidential information.

How do phishers do it?

Phishers send e-mails to a very large number of Internet users, whose addresses have been illegally collected or automatically composed by special tools. These e-mails use the official logos and typefaces of companies such as banks, e-commerce sites and Internet service providers, and ask the user to click on a hypertext link included in the message. The URL of the link included in the e-mail is also "masked" to appear authentic.

Phishing emails are usually threatening to their victims, or contain promises or guarantees.

They often contain spelling mistakes, syntax errors or incorrect information about the customer's references.

However, phishing techniques are becoming more sophisticated and modern. The modus operandi remains unchanged, but bogus e-mails are becoming less crude, more often written in French and with fewer mistakes.

What should you do if you receive a fraudulent e-mail?

If it's an e-mail from a company of which you're a customer (Verycook, banking organization, French Treasury, EDF, etc.): beware of forms in an e-mail or on a website requesting banking information. If in doubt, contact the company's Customer Service department to determine whether they are the official sender of the message.

How can I protect myself from phishing?

As a general rule, never give out your login details.
If you receive an e-mail containing a link to an online form asking you to enter your personal data (e-mail address, Verycook password, bank details, etc.), you have received a fraudulent e-mail and are visiting a fake Verycook site.

Verycook will never ask you to provide your bank details by e-mail or your account password.

10. What happens if our policy changes?

Verycook reserves the right to modify its Privacy Policy at any time, and will publish the modified version on its Site.
